DhvaniWave - Terms of Service

1. Acceptance of Terms

By downloading, installing, or using DhvaniWave ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Pixel Minds ("we," "us," or "our"), the developer of DhvaniWave.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use DhvaniWave for personal, non-commercial purposes, subject to these Terms.

You may NOT:

• Copy, modify, or distribute the App or any part of it
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without our written permission
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App in any way that violates applicable laws or regulations

3. Subscriptions and Purchases

3.1 Premium Subscription

DhvaniWave offers premium subscriptions with the following plans:

• Weekly Subscription: Billed weekly
• Monthly Subscription: Billed monthly
• Yearly Subscription: Billed annually

3.2 Free Trial

3.3 Billing and Payments

• All subscriptions are processed through Google Play Store
• Prices are displayed in your local currency and may vary by region
• Payment will be charged to your Google Play account upon confirmation of purchase
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period

3.4 Cancellation and Refunds

• You can cancel your subscription at any time through Google Play Store
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• Refund requests are handled by Google Play Store according to their refund policy
• To request a refund, go to Google Play Store > Account > Purchase History > Select DhvaniWave > Request Refund

3.5 Token System

DhvaniWave uses a token-based system for accessing certain features:

• Tokens can be earned by watching rewarded video ads
• Premium subscribers receive unlimited tokens
• Tokens are non-transferable and have no cash value
• Token costs for features may change at our discretion

4. User Conduct

You agree to use DhvaniWave in a lawful and respectful manner. You will NOT:

• Use the App to infringe on intellectual property rights of others
• Attempt to gain unauthorized access to any part of the App or its systems
• Use the App to transmit viruses, malware, or other harmful code
• Interfere with or disrupt the App's functionality
• Use automated scripts or bots to interact with the App

5. Content and Intellectual Property

5.1 Our Content

All content, features, and functionality of DhvaniWave, including but not limited to:

• Visual designs and user interface
• Visualizer effects and algorithms
• Graphics, logos, and text
• Source code and software architecture

are owned by Pixel Minds and are protected by international copyright, trademark, and other intellectual property laws.

5.2 Your Content

• You retain all rights to music files you access through the App
• Recordings you create using DhvaniWave are yours to keep
• We do not claim ownership of any content you create or import

5.3 Third-Party Content

Music streamed through Jamendo and other integrated services is subject to their respective terms of service and licensing agreements.

6. Disclaimers

6.1 "As Is" Basis

DhvaniWave is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

6.2 No Guarantee

We do not guarantee that:

• The App will meet your specific requirements
• The App will be compatible with all devices
• All features will be available at all times
• Defects will be corrected immediately

7. Limitation of Liability

To the maximum extent permitted by law, Pixel Minds shall not be liable for any:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or data
• Damages resulting from use or inability to use the App
• Damages arising from third-party services integrated with the App

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

8. Third-Party Services

DhvaniWave integrates with third-party services including:

• Google Play Store (for subscriptions and purchases)
• Google AdMob (for advertisements)
• Jamendo (for music streaming)

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of these third parties.

9. Updates and Modifications

• We may update DhvaniWave at any time to add features, fix bugs, or improve performance
• Updates may be automatic or may require user action
• We reserve the right to modify or discontinue any feature at our discretion
• Continued use of the App after updates constitutes acceptance of any changes

10. Termination

We reserve the right to:

• Terminate or suspend your access to DhvaniWave at any time without notice
• Disable features or subscriptions if we suspect abuse or violation of these Terms
• Discontinue the App entirely at our discretion

Upon termination, you must cease all use of the App and delete it from your devices.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of DhvaniWave shall be resolved in the courts of India.

12. Changes to Terms

We may revise these Terms at any time by updating this page. Changes are effective immediately upon posting. Your continued use of DhvaniWave after changes constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pixel Minds regarding your use of DhvaniWave and supersede all prior agreements and understandings.
